Terms and conditions
The short version. Every account starts with 14 days free. After that ChairHog costs €35 per site per month, billed monthly in advance and excluding VAT. Each site comes with up to ten user accounts. There is no setup fee, no commission on covers and no minimum term — cancel before your next renewal and you stop paying. Your guest data stays yours, and you can take it with you.
This summary is here to be read. It is not part of the agreement, and where the two differ the terms below apply.
1. This agreement
ChairHog is a product of Noximo. These terms are the contract between Noximo ("ChairHog", "we", "us") and the business that opens a ChairHog account ("you", "your"). They apply from the moment you open an account or start using the service, whichever happens first.
ChairHog is sold to businesses. If you are a consumer rather than a business, these terms are not written for you, and separate consumer rights may apply.
2. Definitions
- Site — one venue at one address where guests are seated. Two dining rooms at the same address are one site; two restaurants in two cities are two sites.
- User — one named person with their own sign-in to the ChairHog web or mobile app.
- Guest — a member of the public who books a table at one of your sites.
- Guest data — the personal data attached to a booking: name, contact details, party size, notes and attendance.
- The service — the ChairHog application (web and mobile), the booking widget, and the support that goes with them.
3. The service
We provide ChairHog as a hosted service over the internet. There is one product with one set of features: bookings, floor plans and table combining, the waitlist, guest records, confirmation and reminder messages, analytics, team roles, the mobile app for phone and tablet with push notifications on new bookings, and the booking widget for your own website. There is no higher tier to buy, and we will not put an existing feature behind an extra charge.
We keep improving the service, so features change. We will not remove something you rely on without telling account owners first.
4. Accounts and users
- Each site includes up to ten user accounts, usable across the web app and the mobile app.
- A user account belongs to one named person. Accounts must not be shared between staff, but the same person managing two sites uses one account at each.
- Users on your account are your staff, and you are responsible for what they do in ChairHog.
- Two-factor authentication is required on every account. You must keep sign-in details and authentication devices secure, and tell us promptly if you think an account has been compromised.
- If you need more than ten users at a site, get in touch and we will agree an arrangement in writing.
5. Fees and payment
- The first 14 days are free. Every new account gets a 14-day trial with the whole service available — every feature, real bookings, as many sites as you set up. We do not ask for a card to start it. The trial runs from the day the account is opened, and unless you tell us to stop, the account continues as a paid subscription at the end of it and the first invoice is raised then. One trial per business.
- After the trial the fee is €35 per site, per month. Three sites cost €105 a month, ten sites cost €350 a month, and so on.
- All prices exclude VAT, which is added where it applies.
- Fees are billed monthly in advance by the payment method on your account.
- There are no other charges. No setup fee, no onboarding fee, no commission on covers, no charge per booking, and no charge for extra tables, extra bookings or a busy month.
- Add a site part-way through a month and it is charged pro rata to your next renewal date. Remove a site and the reduction takes effect from the next renewal date; we do not refund part-months.
- If a payment fails we will tell you and try again. If it is still unpaid 14 days later, we may suspend the account under section 13.
- We may change the price. We will give at least 30 days' notice by email, and the new price applies from your next renewal. If you do not accept it, cancel before then.
6. Term and cancellation
- The agreement runs month to month once the free trial ends. There is no minimum term and no notice period.
- Cancel during the trial and nothing is charged at all.
- Cancel at any time from your account or by emailing hello@chairhog.com. The service continues to the end of the month you have paid for, and is not renewed.
- Before you leave, you can export your bookings and guest records. For 30 days after cancellation we keep the data so you can still export it, then we delete it in line with our privacy policy.
7. What you are responsible for
- Giving accurate company and billing details, and keeping them current.
- What you put into ChairHog — your table layouts, your policies, your booking rules and the messages you send guests.
- Being the controller of your guest data: telling guests what you collect and why, having a lawful basis for it, and answering their requests. We help, but the obligation is yours.
- Using the service lawfully. You must not use ChairHog to send unsolicited marketing, to hold data you have no right to hold, to break into it or test it without our written permission, to resell it as your own product, or to copy the software.
- Your own website, including installing the widget on it.
8. Data protection
For guest data you are the controller and we are the processor. We process it only on your documented instructions, keep it confidential, apply appropriate security, use sub-processors only under equivalent written terms, help you answer guests' requests and meet your breach obligations, and delete or return the data when the agreement ends.
Guest details are deleted automatically once the booking date has passed, unless you have chosen to keep that guest on your records. This is how the service behaves by default, and you do not have to ask for it.
The service is hosted on Amazon Web Services in the EU, behind a web application firewall and DDoS protection, with all data encrypted at rest and in transit. We do not store payment card details at any point: subscription payments are handled by a dedicated payment provider.
For your own account data we are the controller. The detail of both, including where data is hosted and how long it is kept, is in the privacy policy, which forms part of these terms.
9. The booking widget
The widget is a script you place on your own website. You are responsible for your site and for keeping the embed code on the pages you want bookings from. We will support the widget on current versions of the mainstream browsers, but we cannot guarantee it against every theme, plugin or content security policy your site might use.
Bookings taken through the widget are yours. We do not charge for them, do not place our own advertising in the widget, and do not contact your guests except to send the booking messages you have configured.
10. Availability and support
- We aim for the service to be available at all times, and we know a booking system is at its most important on a Friday night.
- Planned maintenance is scheduled outside typical service hours where we can, and announced in advance.
- Support is by email at hello@chairhog.com, answered on working days.
- Unless we have agreed a separate service level agreement with you in writing, the service is provided without a guaranteed uptime figure.
11. Intellectual property
ChairHog, its software, design and brand remain ours. You get a non-exclusive, non-transferable right to use the service for your own business while this agreement lasts, and nothing more.
Your data — your bookings, your guest records, your logo and your content — remains yours. You allow us to host and process it only so far as running the service requires. We may refer to you by name and logo as a customer; tell us if you would rather we did not, and we will stop.
12. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, neither of us is liable for loss of profit, loss of business, loss of goodwill or any indirect or consequential loss; and our total liability arising out of this agreement in any twelve-month period is limited to the fees you paid us in the twelve months before the claim arose.
ChairHog is a booking system, not a guarantee of covers. We are not responsible for no-shows, cancellations, or the commercial decisions you make with the information the service gives you.
13. Suspension and termination
We may suspend or end the agreement if you:
- have not paid 14 days after we told you a payment failed;
- breach these terms materially and do not put it right within 14 days of being asked; or
- use the service in a way that is unlawful, or that puts the service or other customers at risk — in which case we may suspend immediately and tell you straight away.
You can end the agreement at any time under section 6. On termination your right to use the service stops, and the data provisions in section 6 apply.
14. Changes to these terms
We may update these terms. We will give at least 30 days' notice of a material change by email to account owners, and the date at the top of this page always shows the current version. Carrying on using the service after a change takes effect means you accept it; if you do not, cancel before then.
15. General
- You may not transfer this agreement without our written consent. We may transfer it to a company that acquires our business, on the same terms.
- These terms and the privacy policy are the entire agreement between us on this subject and replace anything said beforehand.
- If a clause turns out to be unenforceable, the rest still stands.
- Not enforcing a right straight away does not waive it.
- Notices to you go to the email address on your account; notices to us go to hello@chairhog.com.
- Nobody other than you and us has any right to enforce these terms.
16. Governing law
This agreement is governed by the law of the country in which Noximo is registered, and we each submit to the exclusive jurisdiction of the courts of that country.
